When you contact us, subscribe to our mailing list, submit an enquiry, or make a purchase, you may provide personal data including your name, postal address, email address, telephone number, and payment details.

HOW LONG WE KEEP YOUR DATA
We retain personal data only as long as necessary for the purpose collected:
- Mailing list subscribers: until you unsubscribe or withdraw consent.
- Purchase/transaction records: 7 years from transaction date (tax and legal compliance).
- Enquiry and correspondence records: 3 years from last contact.

You may create a hyperlink to the Site provided the link does not portray Emami Art or its artists in a false, misleading, or derogatory manner. Use of any Emami Art logo or trademark requires prior written permission.

GOVERNING LAW
These Terms are governed by the laws of India. Disputes shall be subject to the exclusive jurisdiction of the courts of Kolkata, West Bengal. Visitors from outside India are responsible for compliance with their local laws.

SHIPPING & HANDLING INFORMATION
This page provides guidance on how Emami Art handles the shipping, packing, insurance, and delivery of artworks and publications. All shipping arrangements for artworks are handled on a case-by-case basis in coordination with the buyer.
Please note: Artwork prices quoted by Emami Art do not include applicable taxes or logistics costs. All taxes (including GST where applicable) and shipping, handling, crating, and insurance costs are borne by the client and will be confirmed separately at the time of purchase.

1. ARTWORKS
Emami Art does not operate a direct online sales checkout. All artwork sales are conducted through direct communication with our team. Once a purchase is agreed, we coordinate all logistics personally with the buyer.
Shipping Partners
We work with a selection of specialist art logistics partners whose selection depends on the nature of the work, its destination, and any specific handling requirements. Partners are chosen for their experience with fine art and their capacity to meet the standards required for safe transit. We will confirm the logistics provider and estimated costs at the time of purchase.
Crating, Packing, and Handling
Packing and crating standards are determined by the nature of the work and the requirements of the logistics handler. Works may be shipped in custom-built crates, archival art boxes, or specialist rolled/flat packaging as appropriate. All packing decisions prioritise the safe arrival of the work in the condition in which it left our premises.
- Domestic shipments: typically packed to gallery standard with appropriate protective wrapping and rigid outer packaging.
- International shipments: crated or packed to the specification agreed with the logistics partner, taking into account the fragility of the work, transit duration, and any climate or humidity requirements.
Collectors with specific handling or installation requirements should communicate these to us at the time of purchase so they can be incorporated into packing and delivery instructions.
Insurance in Transit
Emami Art’s insurance cover includes transit insurance for artworks from the point of dispatch from our premises to delivery at the agreed destination if the specialist art logistics partners was involved. Cover applies for the agreed sale value of the work. In the event of damage or loss in transit, please notify us within 24 hours of receipt, with photographic and videography documentation.
Once a work has been signed for and accepted at the destination, responsibility transfers to the buyer. We recommend that collectors ensure their own insurance arrangements cover the work from the point of receipt.
Domestic Deliveries (India)
Delivery timelines for domestic shipments depend on destination, the nature of the work, and partner availability. Estimated timelines will be provided at the time of purchase.

International Deliveries
International shipping timelines vary by destination, chosen logistics partner, customs clearance, and the complexity of packing requirements. Estimated timelines and shipping costs will be confirmed during the sales process. We will provide all necessary documentation to support customs clearance.
Import, Export & Collector Responsibilities
India classifies certain artworks as “antiquities” under the Antiquities and Art Treasures Act, 1972, which restricts or prohibits export. All works sold by Emami Art are contemporary and do not fall under this restriction; however, collectors are responsible for ensuring compliance with import regulations in their own jurisdiction.
For international purchases, collectors are responsible for:
- Provide the local Tax Id of the client
- All import duties, taxes, and customs fees applicable in their country of destination.
- Obtaining any import permits or licences required by their local authority.
- Providing accurate import declarations for the work.
- Any costs associated with customs delays, inspections, or rejection at border.
Emami Art will provide a commercial invoice, certificate of authenticity, and any supporting documentation required for export from India. We are happy to advise on documentation requirements but cannot accept liability for import costs or regulatory compliance in the collector’s jurisdiction.
Customs, Duties and Taxes
International buyers should be aware of the following:
- India export: contemporary artworks by living Indian artists are generally exportable without special licence. We will provide all required export documentation.
- Import duties: many countries apply reduced or zero import duty rates for original artworks. However, this varies by jurisdiction and is the buyer’s responsibility to verify.
- GST / VAT: buyers outside India are not liable for Indian GST on exported goods. However, import VAT or equivalent may apply in the destination country.
We strongly recommend consulting a customs broker or freight forwarder in your country prior to purchase if you are unfamiliar with your jurisdiction’s import requirements for artworks.
2. PUBLICATIONS AND MERCHANDISE
Emami Art publishes exhibition catalogues, artist monographs, and occasional merchandise. These are available for purchase through the gallery directly. Shipping for publications is handled through standard courier services.
Domestic Shipping (India)
- Carrier: standard tracked courier service.
- Estimated delivery: 3–7 working days from dispatch (metro areas); 5–10 working days (other regions).
- Shipping costs: calculated at checkout / confirmed at time of order.
International Shipping
- Carrier: international tracked courier service.
- Estimated delivery: 7–21 working days depending on destination and customs processing.
- Shipping costs: calculated based on weight, dimensions, and destination. Confirmed at time of order.
- Import duties and taxes: any import duties, taxes, or customs fees applicable at the destination are the responsibility of the recipient.
Delivery timelines are estimates only and may be affected by courier delays, customs processing, or circumstances outside our control. We will provide tracking information once your order has been dispatched.
Damaged or Lost Publications
If your publication arrives damaged or does not arrive within the expected window, please contact us at contact@emamiart.com with your order reference. Please see our Refund, Returns & Exchanges Policy for full details on replacements.

REFUND, RETURNS & EXCHANGES POLICY
Emami Art does not operate a direct online sales checkout. All sales are conducted through direct communication with our team. ARTWORKS
Given the unique nature of original works, all artwork sales are final once payment has been received and the work has been released from our premises. We encourage prospective buyers to get in touch with the gallery and we are happy to arrange condition reports or in person or digital viewings, share hi-resolution photographs and videos of the works prior to purchase.
In the event a work arrives damaged in transit, please notify us within 48 hours of receipt with time stamped photographic and/or video evidence. We will work with you and our logistics partners to resolve the matter.
All works are inspected and documented before despatch. Upon delivery, the client or their nominated representative is responsible for inspecting the work at the earliest opportunity. Any visible transit damage must be reported within 48 hours of receipt. Any other claims relating to damage, loss, or discrepancies must be raised within 30 days of delivery. Emami Art cannot accept claims raised after this period.
COMMISSIONS

PUBLICATION AND MERCHANDISE
Publications and merchandise may be exchanged or replaced if the item received is incorrect or defective. To raise a concern, contact us within 7 days of receipt by email at contact@emamiart.com or by phone. Please retain your proof of purchase. Once we have assessed the issue, a replacement will be arranged within 10 working days subject to availability.
If a publication arrives damaged in transit, please photograph the damage and outer packaging immediately on receipt and notify us within 48 hours. We will liaise with our logistics partner on your behalf, but cannot guarantee replacement in cases where damage occurred after despatch.
Orders may be cancelled prior to dispatch only with the written approval of Emami Art. Any costs already incurred in relation to packing, crating, insurance, customs documentation, payment processing, or logistics arrangements may be deducted from any refund approved.
REFUNDS
Monetary refunds (as opposed to replacements) will be considered only in exceptional circumstances at the discretion of Emami Art. Where approved, refunds will be processed to the original payment method within 14 working days.
DIGITAL PRODUCTS
Digital downloads and digital exhibition catalogues are non-refundable once accessed.
